Motorcycle Accident Injury Liability

My boyfriend was hit by an SUV a few weeks ago while on his motorcycle and stopped at a red light. The SUV cut across a marked lane diveder area and hit the motorcycle at an angle. The motorcycle was thrust forward out of control, stalled out, and landed about 15 feet into the intersecting road on its right side. My boyfriend was thrown over the top of the motorcycle and landed 20 feet into the intersecting road on his left side. The motorcycle has about $4000 worth of damages. My boyfriend has severe pain from the injuries. He has been restricted at his job and can't get OT now. We have had to delay personal plans for this summer because of the pain, inconvenience, and stress. The other driver admits to hitting the motorcyle, however, she is saying that he voluntarily threw the motorcycle down. Her insurance company is not accepting liablity. My boyfriend has riden motorcycles on the road for 30 years with no accidents. His motorcycle went down because he was hit by a 6000 pound SUV that wasn't looking. He has given statements to his insurance company and her's. There's a witness and pics of the mark the bike made and the intersection. Does he need to get his own lawyer? What else should he be doing at this point?

He should seek legal advice or represenation particularly since the insurance carrier is denying liabilty and it appears that he has a good claim against the other driver

You should find a lawyer because an investigation will need to be undertaken to determine whether your boyfriend may be entitled to receive compensation, including:

Compensatory damages

Lost Wages

Future Earnings for loss of Earning Capacity; and

Your boy friend should be seeking good medical attention as well as getting an experienced lawyer. The case needs to be investigated. THe accident needs to be reconstructed by an expert. Whenever the other insurance company denies liability you need to contact an expierenced attorney, like myself. But you have 3 years to sue. You should get the proper medical attention. Your own insurance company wil pay a minimum of 2500.00 of medical benifits, and a portion of lost wages, without raising your premiums.
