Pain and suffering through no fault insurance
My wife was hit by a drunk driver that has no insurance etc. We have no fault thru our auto insurance company. They gave me blue book on my auto and are I beleive paying my wifes medical bills. Can my wife claim pain and suffering against the no fault policy, or do I have to get help to do so?

Your "no-fault" or PIP coverage does not cover you for pain and suffering. You should have uninsured motorists coverage (UM) on your policy, which entitles you to claim all of your wife's losses (including medical bills, wage loss, etc., through that coverage. Check your policy to see what your coverage limit is. In these circumstances, your own insurance company stands in the shoes of the other driver and defends the claim. You should definitely seek the assistance of an experienced personal injury attorney to assure yourselves that your case is handled properly and that you are receiving a full and fair recovery for your losses and injuries.

While you don't *need* help to make a claim against an insurance company, I strongly recommend it. Don't forget--the insurance company's goal is to pay you as little as possible, and the agents receive training to teach them how to do just that.
