Pedestrian vs. Driver

I was making a left turn (I had the green arrow) on a dark and slightly rainy night. I hit a pedestrian who was outside of the crosswalk not mention wearing all black. I did not see the guy until the lights on my car was facing him. I swerved to the right to avoid a collision but the guy jumped back into my car. My speed couldn't have been no more than 20mph as I had just came from stopped light. The pedestrian got up and atempted to walk away but I encouraged him to have a seat on the sidewalk as I called an ambulance. He has since gotten a lawyerto represent him. Am I fully at fault?

You didn't state if you contacted your insurance company. Even if you haven't at this point, do it.

The company will provide you with a defense and possibly settle the matter.

You also didn't state if the police were called. In your case, this may have provided evidence of pedestrian fault.

Just because you hit a pedestrian does not mean you are liable. In fact, in certain major cities, a significant minority of cases are caused by pedestrian carelessness.
