Personal Injury, Slip & Fall

I broke my elbow after a fall in a parking lot of a mall. I now have elbow pain whenever the weather changes and a lump on my wrist that hasn't gone away since. The ins. company wants to settle for $2,000. Should I be asking for more?

It really depends on what caused you to fall. The law does not hold the owner or maintainer of property responsible for anyone who injures themselves on their property. You must prove that your injury was a result of the failure of the property owner to maintain the property in a safe condition. For example, if you tripped over an obstruction that you couldn't see and which they should have known about and been able to remove or correct, that would be grounds for holding them responsible. If you think you can establish that you fell due to the unsafe condition of the property, then $2000 for the injuries you described seems low. An experienced personal injury attorney can evaluate the case and probably negotiate a better settlement for you then you can for yourself.
