If you are claiming the doctor's treatment of you caused you injury or damages, either because he/she failed to diagnose a condition, failed to properly treat a condition, negligently performed surgery, or otherwise did not meet the proper standard of care, it is considered malpractice. Sometimes a count of battery is added, but that is unusual and hard to prove.
