Legal Question in Personal Injury in Maryland

Recently had consultation and x-rays with Chiropractor(9/21) due to low back pain. Results(9/23) were subluxations(said can occur with slips & falls). End of August, slipped at an indoor waterpark, left forearm hit step trying to break fall, landed on buttocks at bottom of steps. First Aid gave ice for knot on arm. Gave an incident description to First Aid person who filled out form. Question: How do I determine if present back condition is or is not a result of slip on steps? I welcome any assistance with this question.

Thank you,

Debra Kane

Your doctor should be able to assist you with that, and you yourself should know, especially if the pain first started after this incident. The big question is causation. Was there a problem with the steps or how they were maintained that caused you to fall? If you think the accident was the water park's fault and these injuries resulted from it, you should consult with an attorney.

Ms. Kane-

Your chiropractor should either be able to render an opinion as to the causal relationship of the fall to your current problem, or should refer you to a specialist--either an orthopaedic surgeon or a neurologist--for follow up. If the back problems presented themselves shortly after the incident, there is a likelihood of a causal connection. If however several weeks passed before the onset of lumbar (back) symptoms, it may be difficult to make the connection. It sounds like you didn't seek medical assistance until the 9/21 consult. If your lower back and buttocks were painful at the time you gave a statement to the first aid person, hopefully that person mentioned that in the report.
