Legal Question in Personal Injury in Maryland

3 friends(Bob,Jim & Paul) were playing golf and one was drinking (Jim) he got mad at Bob and swung his club at Bob, he missed Bob but accidently hit Paul. Paul had to get stiches. Can Paul sue Jim and if so on what grounds?

Yes, Jim is liable to Paul for assault and battery and/or gross negligence. Although he intended to hit Bob, the law says his intent is transferred to Paul when he acts this way. He should have realized before he committed the act that Paul was in the zone of danger.
