Legal Question in Real Estate Law in Maryland
Alleged errors on a property settlement
In February of 2003, my daughter and I settled on some property we jointly owned. The settlement was conducted by an attorney, selected by the buyers who was proported to be a real estate expert. He was poorly prepared for the transaction, the settlement sheet contained no less than 10 errors which had to be corrected at the table. It went so far that we discovered he was about 3 revisions back on the property description and even that had to be corrected prior to money changing hands.
3 months later, this attorney calls me and attempts to claim he made a $4800 error on the settlement, claiming to have paid a portion of our funds out the wrong ''account.'' At the end of the settlement he cut several checks, one to me, one to my daughter and one to the civil engineer who prepared the surveys and descriptions of the property we sold. That check is the one he claims he issued incorrectly. Even if he did actually make this mistake am I obligated to finance his stupidity?
Ps: He wrote the check to the surveyor, isn't his beef with him?

Re: Alleged errors on a property settlement
Your question strikes upon three issues. Did the attorney err, did the seller err, or did the buyer err? The sales or representation agreement may bear scope limitations upon the matter. You probably have actionable response to this claim.
