Legal Question in Real Estate Law in Maryland

Breach of Contract / Theft

A friend and his girlfriend purchased a home together, he was accused & convicted of domestic abuse. While serving his term (14 months) his girlfriend had him sign title to her under the premise that he would be able to regain title when he was released. He has a notarized letter stating this fact signed by them both. At the time that he signed the letter she gave him a check for $1500 as collateral that she immediately stopped payment on upon leaving the prison. What are his options at this time.. He no longer wants ownership of the home. He just wants compensation for what he has paid into the house approx. $30,000 (down payment, 3 years mortgage payments, home improvements)Can he sell the house? Offer her a buyout? Does he have options?? He has very limited income at this time so if you have suggestions that we could pursue intitially on our own it would be greatly appreciated.

Re: Breach of Contract / Theft

It all depends on the title that he has. You speak of a written agreement that should be reviewed by an attorney. This agreement is pivitol. As stated it appears that he has a claim for $1,500.00 but again this depends on the agreement. The agreement could be an option contract that may or may not void.
