Breaking Apartment Lease
Hello,
My apartment lease is scheduled to end Oct. 31, 2006. I gave me sixty day notice in the beginning of August and stated in the notice I will be vacating the apartment on Aug. 20. I ended up giving the keys to management on Aug. 22 at what point I was told my apartment was on the market and as soon as it is rented I will not be obliged to pay the rent. On Sept. 3 I came to pay the rent, another employee had leased my apartment for Nov. 7, therefore still making obliged for the rent until Oct. 31. This employee was clearly unaware the apartment was available after Aug. 20th as she asked me 'have you given your keys yet', which I had given Aug. 22 along with having the final inspection performed. Furthermore the listing sheet had my apartment available at Oct. 31, the employee who I originally spoken to said that is how it written in our system ending on the lease date. But the emplyee who leased the apartment did not know it was available after Aug. 22. I don't believe my apartment was marketed properly as I was told in good faith. This apartment complex is very busy in leasing during the time I vacated and uptil now (I observed and was told this myself).

If I understand your question correctly, your lease ran through the end of October. Therefore, you were obligated to pay rent through that date, unless the landlord was able to find a new tenant whose occupancy began earlier. But the landlord had no obligation to do that just because you decided to move out before the end of your lease.
