Legal Question in Real Estate Law in Maryland
I brought a house that is being built. When I purchased the home I told the representative that I specifically wanted land where I can put a fence up in my backyard. The representative told me that he confirmed with HOA that I could put a fence up in my backyard so with having this information I proceeded to sign a contract to get my house built. I found out about four weeks ago that HOA will not allow me to put a fence up in my backyard. I don't want this house. I am willing to still buy a house with this agency as long as I can put a fence up in my backyard. I have the email from the representative where he confirms that I did state I only wanted property where I can put a fence up and he told me that I was permitted to put a fence up. My settlement date is February 28th. I will have to take the company that sold me the house to court. Do I have a case that would probably win in court?

It would be pretty tough for a lawyer to say whether you have a case or not without first looking at the sales contract and those emails.
