buying and selling to investors

is it legal to buy a property for $50,000 and sell it for the apraised value of $100,000 and give the buyer $40,000 back out settlement

Remember the old saying "If it sounds too good to be true, it probably is". Having said that, you have not provided sufficient facts to determine whether the sale is "legal" (in any sense of that word). However, the part about the buyer getting back $40k sounds unusual -- where did that money come from? If it came from a bank who financed the purchase, the fact that the buyer was leaving the settlement table with $40k would have to have been above-the-board with the bank that made the loan -- otherwise, there may be problems.
