Own a completely paid timeshare in Maryland. How long will my estate be encumbered with maintenance fees if the heirs refuse acceptance of the timeshare?

Your estate will continue to own the timeshare, and therefore be responsible for maintenance fees until it relinquishes ownership. This would require either selling the time share or returning it to the management company if that option is available. There may be a provision in the ownership agreement or bylaws of the development that provides for forfeiture of ownership if fees go unpaid for a certain period of time. Your heirs would never become personally liable for these fees if ownership is never transferred to them individually. If the timeshare management company files a timely claim against your estate for unpaid fees, it will hold up closing the estate. But if no claim is filed with the Register of Wills before the estate is closed and all of its other assets are distributed, they would be unable to collect any fees from the estate.
