Legal Question in Real Estate Law in Maryland

condo bylaw amendments

I am an onwner and on the board at our association.

If we amend a section of our bylaws, are we required to publicly record this amendment at the county courthouse?

And, is it enforcable the second it is approved by council or the second it is recorded if required to record?

Re: condo bylaw amendments

The present by-laws will identify the appropriate action, if any. Recordation is recommended for public notice. Depending on the county, or the type of association, or change or amendment to the by-laws there may be a requirement to record.
