Legal Question in Real Estate Law in Maryland

Condo Question on Malice

I live in a single family house but it is considered a condo not a HOA. We have had problems with leaks. The ins co pd the cond but the condo wont release funds. Can I sue them and get attorneys fee's. How much enforcement does the AG's office have and do they get involved with things such as this. This condo board is self serving at best. What is the best way to go after a board and cause them to spend so money on lawyers. I live in AA county, MD

Re: Condo Question on Malice

Assuming you are not the only member with this problem, you should try to organize the affected members and force a vote of the association to release the funds. Condo associations have a lot of self-governing authority and it is hard to get court intervention. Review your bylaws to learn the procedure for passing a resolution to require action by the board.
