contract confidentiality

I am selling my home without a realtor. The buyer and i signed and had notarized a contract calling for a $500 deposit, but he only gave me $100. We wrote a separate contract (on a piece of paper that was not notarized) which said he will pay me the other $400 by aug 7. It is a rather brief contract, only one sentence. Anyway he signed it and i have it. Aug 7 comes and goes, no money only excuses. Well now almost 3 weeks later im frustrated and tape the written contract that calls for the rest of the deposit outside my house. dumb i know. My buyer lives next door with my neighbors and just wanted to reminder him really. It was out there aprox 4hrs. I also put out a sign ''for sale by owner.'' Never showed the house or took any other contracts on it, bacicly just wanted to get the guys attention. Well i did, he goes to small claims court and is now suing me for breach of contract and damages for breaching confidentiality for hanging the piece of paper outside for 4hrs. Should i be worried?

It's the buyer rather than you who is in breach of contract because he failed to post the deposit when it was due. Also, there's no "breach of confidentiality" cause of action. His small claims suit is without merit. You should learn from this experience and hire a realtor to sell your property.
