cross complaint not hear at trail

I went to trail regarding a foreclose rights of redemption. The purchaser of the tax certificate, entered my property, changed my locks and completely gutted my property. I filed a cross complaint for injunctive relief and damages, but the court didn't hear my cross complaint. An order was never signed foreclosing my rights of redemption and I still own the property, but the damage done to my property still has not been addressed by the court. Do I file another suit to address my damage?

It depends on the reason the court "didn't hear" your cross-complaint. If the judge dismissed that claim with prejudice, meaning you had no right to bring such a claim, your only remedy would be to appeal that decision within 30 days. If the judge refused to hear it because he/she felt that should be heard as part of a separate case, then you would file that case.
