Legal Question in Real Estate Law in Maryland
my dad died and left his share of my grandmothers property to his five sons my older brother was left trusty over our share all our names are on the well, can my older brother sale the property and keep all the money with out dividing it among all five of his brother
1 Answer from Attorneys
No--as a trustee he is responsible for protecting the interests of all the brothers. Depending on the terms of your father's will, your brother may have the authority to sell the property, but then he would have a duty to get the best available price, and once sold, to divide the proceeds as prescribed by your father in his will. You would be smart to get a copy of the will and meet with an estates attorney who can review it and advise you specifically of what you can expect, and can also protect your rights if necessary,
