Legal Question in Real Estate Law in Maryland

Dear LawGuru Team,

My ex-boyfriend, who I lived with from 2003-2009, gave my son a dirtbike for his 5th birthday in 2005. When I moved out with my son in August of 2009, he refused to allow me to take the dirtbike for my son, even though he gave it to him as a birthday present. Do my son and I have any rights to this gift?

Yes--the dirtbike belongs to your son, or legally to you as custodian of your son. Once an unconditional gift is given to someone it becomes the donee's property and the donor cannot take it back.
