Debt to new apartment owners

Hello,

After I moved out of my old apartment, I was presented with an invoice of backrent and penalties that I do not feel I owe. A few months after I moved out, the apartment complex was sold to a new management company. Now the new management company is seeking to collect for the balance owed. Can they legally do this even though my lease was with another management company?

The purchase and transfer of the premises passes to the new owners with all the rights and privileges held by the transferor. THe new owner simply steps into the shoes of the seller. If the seller owed taxes, the new owner would have to pay them. Your contract with transferor is part of what is being transferred. But don't admit to anything yet. you may have other defenses to the claims.Good luck.

The new management company obtained an assignment of all claims held by the old management company, so the change of management doesn't help you.
