Legal Question in Real Estate Law in Maryland

I am on the deed, but not the mortgage

My name is on the deed of a home. I am paying the mortgage and the taxes. However, my name is not on the bill or the tax information from the bank.

Am I an owner of the home, can I claim the taxes.

You can legally claim your percentage interest in the property, but presumably the lender is sending IRS a Form 1099 indicating the interest and taxes are being paid by your co-owner (using their ssn). So this could trigger an audit. If you and your co-owner are in agreement on this, you should contact customer service at the lender and try to get them to list your name and ssn as the primary on the account.
