Legal Question in Real Estate Law in Maryland
Difference in settlement
I sold a house in MD and the title company obtained an invalid address to send the settlement check to, which they would not tell me where they obtained this address. When a new check was cut my realestate agent went and picked up the check to mail to me and she noticed that the amount was not right once she went to mail it to us. She was correct the amount was around $160.00 short of what the settle documents have on them. What recourse of action can be taken against this arrogant company they appears to be trying to steal money from clients?
Thank You

Re: Difference in settlement
You should write a letter to the title company requesting an accounting and explanation as to why the settlement proceeds are less than what you signed for on the settlement statement. They have no authority to disburse less than that amount to you without your approval or an explanation. You should copy the MD Attorney General's office. If it's a law firm or attorneys that did the closing, you should also copy the MD Attorney Grievance Commission. Also, your agent should be able to contact the title company and get an explanation; it might be an innocent mistake quickly corrected once brought to their attention.
