Legal Question in Real Estate Law in Maryland
Eviction from legal residence
My live-in girlfriend with no rights of ownership (not on my deed) has a temporary protective order against me. If the order is granted at the hearing one week later, can I be forced out of my own house?

The court has the authority to order you to leave, since your home is your girlfriend's place of residence. However, the statute instructs the court, in deciding whether to order vacation of the premises by the respondent, to consider as a factor the title to the property. Presumably you've had your merits hearing by now unless it was postponed, so I hope you were able to avoid a vacation order. If not, you do have appeal rights.
