Legal Question in Real Estate Law in Maryland
eviction
I have a two year lease that expires in 12/2000 and I just received notice of eviction because my landlord did not pay his morgage. The bank sold the apartment back in September and I just now learned of this today that we have to get out. Is my landlord breaking our contract and does he have any responsibility for the moving expenses we will incur?

Re: eviction
Absolutely. The Landlord had a duty to provide you quiet enjoyment of the unit for the term of the lease. His failure to do so was a breach. However, I would not expect to recover very much, since his failure to pay the mortgage is indicative of a lack of financial resources from which you could collect.
