Legal Question in Real Estate Law in Maryland
Right of way expiry?
We have a17' ''right of way for egress
and ingress and public utilities'' , the
only access to our home. Under what
circumstances can a right of way be
denied by the owners of the land?

Re: Right of way expiry?
If there is no expiration on the right of way and if your intended use is within the scope set forth in the document, you have an enforceable right. If they don't have it, provide the landowners with a copy of the right of way and advise them that if they continue to refuse to abide by it, you will take court action, seeking specific enforcement, damages and legal fees.
