Can i file for a sale in lieu of partition myself, how do i go about doing it and how much would it cost?

Yes, it is possible to represent yourself in such litigation. As with any court proceeding, you will want to make sure you are comfortable with the legal and procedural rules before filing. If you are not, you may want to retain an attorney skilled in this area. At a bare minimum you would need to pay the circuit court filing fee (varies slightly by county) and costs for service of process to get the case started. If a trustee is appointed, the trustees commissions would need to be paid, and if a realtor or auctioneer is employed by the trustee, those costs (usually a percentage of the sale price) must also get paid. Since these things are based on the property value it will be hard to pinpoint ahead of time.

In appropriate circumstances my firm handles these types of cases either on an hourly or on a contingency fee basis. You may want to consult with an attorney before filing a lawsuit yourself.
