Legal Question in Real Estate Law in Maryland
Fraudulent transactions with Real estate agent and broker
I really need to talk with someone regarding the attached situation. An agent showed us the property, there was no other contract on this house. the agent then put us in touch with her Mortgage guy insisting that he was much better than the one I had. We had the pre-approval and authorization and she then told us to have the property appraised. The mortgage guy then asked us to pay him $100 for termite inspection, which was paid directly to him, the agent never provided a copy when asked. This past weekend the agent from Coldwell came by my house to pick up a check for $1,000 said that was for good earnest deposit money the agent is saying that we are supposed to go to closing Fri The next message I have from the agent, it says that ''yes the broker is a fraud'' When I contacted the agent to discuss everything that was going on, she tells me, well there's nothing she can do about all the money we spent and that I just have to write this off on our taxes. When asked about the sellers, the agent replied that the sellers decided to go with the back up contract.

Re: Fraudulent transactions with Real estate agent and broker
This agent clearly has not served your interests properly, and you need to file a complaint with the local real estate board to get them to investigate. You should also demand return of your money, since you are entitled to your earnest money back if the contract doesn't close.
Usually an agent doesn't recommend a mortgage broker unless they have a long standing relationship and the agent would be familiar with the broker's credentials. You can also file a complaint with the Md. Attorney General's office if the broker is improperly withholding your money.
