Legal Question in Real Estate Law in Maryland

I'll give the brief version..I bought my first home from a couple in March '08 and in August of '08 I noticed mold near my utility closet. The man that I purchased the house from (G.J) works in HVAC and he installed the until in my home. He also gave me a year warranty for the unit. When I saw the mold I called him, he came the same day with a colleague. The colleague asked, "who installed the unit, this is installed incorrectly." He was referring to the pipe. G.J. said, "I installed it." The colleague fixed it and G.J. said, "put some bleach on that and you should be fine." I noticed that my carpet was damp, so I pulled up the carpet and to my surprise, lots of mold. I told G.J. he admitted no responsibilty. I had the mold remediated. I think I have a case, but not sure. Thoughts?

If you can prove that the improper installation of the HVAC was the cause of the mold, you should have a case against GJ. Consult your remediation person for their input on this question, and if they agree, ask them to write a letter addressing it. If GJ still resists, you would have to call your expert as a court witness to prove your case.
