Legal Question in Real Estate Law in Maryland

My finance and I built a home two years ago, and have lived here together with my 10 year old son since June 2010. He was the only name on the mortgage, deed, etc. and he suddenly passed away 2 weeks ago. I am interested in assuming the mortgage, as I do not want to lose our home, but am not certain that I will qualify for the loan. What are my options?

Unless your fiance had executed a Last Will and Testament leaving the property to you, you will probably not be entitled to inherit it. It will go to any children of his own, or if none, to his parents and siblings if any. If there were none of these, other members of his family would be entitled to inherit the property. Unless these folks are willing to give the house to you in light of the circumstances, or at least to sell it to you, you will lose out. I hope he was wise enough to have a Will in place. I strongly suggest you contact an attorney who is familiar with estate law as soon as possible to find out more specifically what you are facing.
