Legal Question in Real Estate Law in Maryland
I own my house. my ex lived there with me, he left 8 months ago and took most of his things. he never came back for the rest . now he wants it. i gave him his posessions but he left the furniture we bought together. I think he pretty much abandoned this stuff and he took things that we both paid for as well. If he takes me to court, could he win these things back and would i end up paying money to go to court if im summoned.

Your ex is entitled to any property he brought into the marriage, or property he acquired by gift or inheritance. Items bought during the marriage, even though by him and for him, are considered marital property since they would presumably have been acquired with marital funds. It doesn't matter whose income was used to purchase it, even if that could be determined. You should try and work out a settlement with him which recognizes that he's already taken marital property--the things you both paid for. If you can enter into a written agreement, it will avoid having to fight over this in court. It sounds like you haven't been through divorce left since he only left recently. Once you've been separated for a year you could file for divorce, and any unresolved property issues will be determined by the court as part of the divorce.
