Legal Question in Real Estate Law in Maryland

I want out of our house

I have been living with a man for 9 years. We bought a house together 2 years ago. Since then, he has had an affair, been caught steeling, and come up dirty on a drug screen. I want out. He says he won't sell. Is there any way I can get out and protect my credit, such as forcing him to sell? Neither he or I make enough annually to assume the mortgage on our own.

Re: I want out of our house

I cannot respond to your specific circumstances without having additional facts. However, I can describe some basic features of Maryland Real Property Law.

People in Maryland who are not married but who own property together may own such property as either "tenants in common" or as "joint tenants with a right of survivorship". Depending upon how a property is titled, each party may have different types of rights.

Under certain circumstances, depending upon the way the property is titled, and many other factors, parties who own real property may bring legal action to force a "partition and sale" of real property.

Whether such would be legally possible or practical for you would depend upon the precise facts of your circumstances.

I would be happy to offer you a short telephone consult free of charge if you would like to follow-up on this matter. Please contact me at 301/220-2200.
