Legal Question in Real Estate Law in Maryland

If my husband and I own a home together and I have bad credit and a judgement or two against me. He has good credit. Can they or anyone take our home or put a lien against it?

Hello. I am a Maryland barred attorney and practice in this area. The answer depends on how the house is titled. In this state, if you own a home jointly as a married couple as tenants by the entireties, individual creditors of either one of you cannot get to the house. However, creditors for joint debt of both of you could still attach the house.

Because there are several different ways jointly owned property can be titled, I encourage you to look at your deed and verify that it does list you as husband and wife owning by the entireties While not legal advice, I hope this post helps.
