The answer to your question depends on a few things. First, do you have a separation agreement and what does it say about this type of situation? Second, are you on the deed to the home? If so, you can likely recover half. I strongly recommend that you hire a family law attorney (if you have not done so already) to assist you -- perhaps a sternly worded letter will be enough to do the trick. If not, you will need to go to Court and have a judge order your husband to pay you half the rent. If you cannot get it now, you may ask for it as part of the equitable distribution of property if you get a divorce.
