husband and wife on their homes deed. the husband was the only one on the loan, the loan co. failed to put the wife on the loan..the husband passes away. 1. who owns the home? 2. can the bank foreclose on the house?

1. It depends on HOW the wife is on the deed to the home. Wife should have a Maryland real estate or probate attorney take a quick look at the deed. It will take only a few minutes to determine if the wife has any, some, or all of the ownership interest in the home.

2. You need to provide more information, but yes, the bank can foreclose on the house even when the mortgagor (the husband) has passed away. Speak with an attorney about the specifics of your situation.
