Landlord and Property Manager
We have a rental home in Riverdale, Maryland. In 1994, we appointed a Property Manager and we are paying commission to the manager. From the beginning we wanted to sell the house. After a couple of years, we asked our Manager to arrange to put the home on the market. He did not. As he said the party was paying rent regularly, we also did not bother him.
Since 1994, he says that he has raised the rent just 100 dollars only. He has fixed $1005 per month for the house. Actually it is worth at least $1250.00 per month. After some time the manager started telling that the tenant is not paying the rent regularly. He kept on adding the amount showing as owner�s debt. We insisted him to collect the money from the tenant, and also told him if the tenant did not oblige, ask him to locate the home. At the same time we brought pressure to sell the house. Now he is saying that we have to pay about $12,000 and he is not showing any interest to sell the house. He says we have to spend some 5-10 thousand dollars to make the home sellable.
My question is once we appoint the property manager to manage the house, isn�t it manager�s responsibility to collect the rent from the tenant instead of asking us to pay. What should we do now?

Most often, a landlord who is not receiving rental payments takes action well before large debts accumulate. If the property manager failed to take appropriate action, he/she or his/her company may have liability for damages caused. The facts presented here are unusual. Something doesn't sound right.
