I received a phone call from my landlord indicating that I should receive a summons to appear in landlord and tenant court regarding non-payment of rent/mortgage. I pay my mortgage/rent bi-weekly in the amount of $650 - 1100. Can I be taken to court for non-payment of rent/mortgage if I am paying on a bi-weekly basis? Please advise. I was advised that I am scheduled to appear in court on 8/13/02. Thank you.

If you do not pay rent in accordance with the terms of the lease,

then your landlord has the right to take you to court and seek a judgment to

recovery unpaid amounts and any other legally permissible recovery that is in the

lease (i.e., penalties, fees, etc.). The landlord also has the right to seek an order of

eviction; however, self help (i.e., the landlord evicting without a court order) is not permitted.

There is statutory relief which permits you to remain where you make your payments current (See another response

that I provided to another question).

IF the rent has not been paid, then landlord is entitled to go to court and ask to have an order granting posession of the property.
