Legal Question in Real Estate Law in Maryland

We placed a lien on a member of our HOA who wasn't paying his dues. He has now paid all that was owed. How do we remove the lien from the property? What is our first step?

You simply record a Certificate of Satisfaction. If you used an attorney to file the lien, they should be able to prepare this and file it without much hassle.

You should take prompt action to remove the lien as a complaint against the HOA can be brought where diligence in such accord is not applied. Such a complaint may cause expenditure of HOA funds for unnecessary representation and could possibly result in an adverse judgment against the HOA.

In addition, collection of HOA fees depends on the type of association. Obtaining a judgment for collection is another option.
