Legal Question in Real Estate Law in Maryland
I live in a development that has a Homeowners Association which I pay yearly dues. The Homeowners Association hired a lawn service to cut the common area. There is a strip of grass in front and on the side of my parking area. I have a new truck and this Lawn service uses a edger with no guard and a blower, blowing grass stones and whatever on my vehicle. I went to the Homeowners Association and they gave me the number of the Lawn Service. I have called them several times with no resolution. The other day I called and the owner came to my house with his crew and screamed at me, telling me I should wash my car and stop bothering him. He continued to scream making derogatory statements and one of his crew told me that they could come back and do some real damage to my truck. The owner also told me that they would continue doing this. I called the police and they told me it was a civil matter and wouldn�t even come out. What is my legal right??? Why should they be able to continue to do this? What should the Homeowners Association be doing for me? Please help.

The HOA needs to intervene and find a more responsible lawn service or put a stop to this practice. If they won't take action upon your request, check your HOA bylaws to see what you need to do to start a petition to replace the service. Of course it may be tough to get fellow owners to join you since it appears this problem is unique to you. Of course, you can take direct action by suing the lawn service for property damage to your truck, but it shouldn't have to go that far.
