Malicious Destruction of Property:

I am the victim of my boyfriends exwife doing $1300 worth of damage to my car, he saw her do it & I heard her do it. I called the Police right away, The Police Office and Corporal responded and she confessed to doing it saying she was just being stupid and couldnt control herself, meanwhile she did it infront of her 2 and 3 year old they are in the middle of a custody hearing for, its a pendetite lite custody order, final evaluation is set in for Jan 6th, I filed Criminal charges for malicious destruction of property and our court date is set in for December 29th. She told family court services that my boyfriend tried to hit her that night she kicked my car, and I believe she is going to try to use that excuse in court. However when the police officers came out she never mentioned it to them and shes looking for an excuse to get out of paying for my car and paying for the criminal act that she did. I am just trying to get everything in order, what should I have ready in order to proceed and get the maximum that the state can give her for this. She verbally assults me, and threatens me alot. I tried to file for a peace order, however it got denied the judge couldnt find suffient proof or reasoning. I am going back up to the court house tomorrow and filing for another one after the verbal threat I recieved again. I need a little guidance on this case and what I should do. Please?

Here's a few suggestions:

1.) Hire a Maryland family law attorney to represent you -- you will get much better results and have someone on your side that knows the legal system.

2.) Move! The best way to get away from the ex-wife is move away from her.

3.) You are involved in a LOT of drama. Consider how important your relationship with your boyfriend really is to you -- is it worth all of this? This woman will ALWAYS be his ex-wife, whether you remain his girlfriend or your relationship ends up in marriage. Do you want to deal with this woman the rest of your life?

4.) When you appear before the judge, bring the original police report. Explain to the judge that you fear for your safety. Give specific examples. Cry if you need to.

5.) Have a criminal background search done on the ex-wife before you go to Court. Is it possible that she's been charged with other types of violent crime or had protective orders taken out on her in the past? If so, this would help the judge make the decision.

6.) Discuss with your lawyer suing the ex-wife in civil court for assault. Perhaps if she gets hit in her wallet, she will back off.
