Legal Question in Real Estate Law in Maryland

My mortgage company is giving me the run around on my modification application. Every time I call they give me a different answer, from "you're missing information" (which I submit) to "it's in underwriting." I've been told that I would know something "any day now" and then the VERY NEXT day I'm told it will be up to 90 days. Can I sue them for unlawful process of my application, since they have government funds to help people like me.

That would accomplish nothing. They probably are short-staffed to handle the number of applications generated by the new law.
