Legal Question in Real Estate Law in Maryland
moving contract
the moving co. is saying we refused delivery of our goods and wants and extra $500. We have a binding contract with them for a set amount. They said they would be at my house at 4pm, it was 8:30pm and they still were not here so we told them to come back in the morning. Now they say if we don't pay them the $500 they will put our stuff in storage and put a lien our it. The contract doesn't mention any date and time of delivery, it just says any time after 1-7-07, no specifics. What can I do?

Re: moving contract
my recommendation is to not make it worse by prolonging your problems.
pay the extra money now, get your stuff, and then if you feel like they did something wrong you can sue them in small claims court to get the money back. just make sure not to sign any type of release.
They have the upper hand right now because they have all of your property and they aren't going to give it to you unless you pay.
Alternatively, you could go to court now, file a complaint in district court for replevin to force them to give you your stuff, and probably another complaint as well for breach of contract and consequential damages. Theoretically, you could also go to circuit court and file a motion for a temporary restraining order directing that they deliver the property to you or make it available. The problem is that these options will be relatively expensive in terms of legal fees (certainly more than the $500 at dispute right now).
