Neighbor suing me alleges my gutters flooded his basement

Neighbor is suing me, and he alledges that the gutters and downspouts of my town home caused his basement to flood.

I believe that he is retaliating against me because I've called police on him when he and his workers were illegally trespassing onto my property and were working on my roof. The neigbor has a history of harassing/stalking me.

I plan to get receipts/statements from companies who maintain my gutters. I also plan to subpoena the police officer who anwered my call regarding my neighbor illegally trespassing.

I haven't seen the documents written by his workers until the sheriff served me with a summons to go to court. I believe neighbor is trying to extort money from me.

What do I need to do to win the case?

You would be wise to seek the representation of an experienced litigation attorney. Have you checked with your insurer to see if they will cover you for this? If so, they'll provide the attorney.

An attorney representing you would immediately undertake discovery procedures to determine what evidence the plaintiff has to support his claim. These include interrogatories, document requests, and possibly a deposition if you are in the circuit court. If you want to represent yourself, go to the law library at the circuit court in your county and look at the Maryland Rules, Sec. 2-401 or 3-401 and following for more information on how to do this. You can also read up on cases in this area of the law that will tell you what has to be proven in order for the plaintiff to win.
