Legal Question in Real Estate Law in Maryland
Neighbor's Water Run-Off Creates Waterfalls and Rivers around my house
Please Help! Whenever it rains, water collects in my neighbors yard and then runs over onto my property. My neighbor's yard become a pond: 2 feet deep and 12 feet circumfrance. The amount of water that collects is so massive, that it creates waterfalls and rivers around and under my house for DAYS after it rains. My yard is CONSTANTLY muddy - rain or shine. If it weren't so near the house I wouldn't care; but the rivers and waterfalls run right past the only door to the house. By the time I get to my car my feet are soaked and my shoes are completely muddy. I can NEVER wear my shoes in the house - EVER - because walking from my car to my house makes them get caked with mud - even when it hasn't rained in a week! This is insane! Isn't there a law to protect me from my neighbor's mess?
By the way, it seems like the water forms there naturally, although my neighbor did mention that she dug a hole in the area which made the water collection worse.

Re: Neighbor's Water Run-Off Creates Waterfalls and Rivers around my house
If your neighbor won't agree to bring in a contractor to see if a drainage system can be installed which would prevent the water from coming onto your property, you may have legal recourse in the form of a suit claiming your neighbor's property constitutes a nuisance and is depriving you of the full enjoyment of your property. Have you explored whether your property can be protected to divert the water elsewhere? If so, that might be a better solution.
