My nephew has lived in his apartment for the past year and a half, he was sentenced to a term of five years for vehiclar manslaughter yesterday, how can his lease be terminated legally ?

Typically a tenant starts off with a 1 year lease, and then it becomes month to month after that. If that is your nephew's situation, he can give 30 days notice to the landlord to end the lease. If the original lease is still in effect, legally he's still obligated but someone could write the landlord and advise them of the circumstances so the landlord can try and re-lease the apartment as soon as possible.
