Hi, I rent a condo. My lease states the owner will pay the condo fees. I have found out they have not been paying the condo fees. Now, I am not going to be allowed to use the pool this summer. What can I do?

Write the owner a letter informing him that he is in breach of the lease by not paying the condo fees. Inform him/her that if he doesn't clear this up by your next rent due date, you are going to pay the fees and deduct that amount from your rent as a resolution. If you don't hear from him, you assume he/she is in agreement with this plan by accepting the reduced rent. Then if s/he tries to evict you, you can defend a rent suit on that basis. Or you can declare the lease void by virtue of the breach and move out.
