Legal Question in Real Estate Law in Maryland
Real Estate - Partition Suit
I own 1/4 of a farm in Maryland. My brother owns 1/4 and my aunt owns 1/2. Have waited 6 years to get family to agree to sell. Need the money and want to sell. How do I force a sale?

Re: Real Estate - Partition Suit
You have to file suit against the other owners for partition or sale in lieu of partition. If the farm is subject to partition in kind, the court will divide the actual farm and you would get 1/4 of it by value; alternatively, the whole thing would be sold and you would get 25% of the sale price.
