Legal Question in Real Estate Law in Maryland
Recording a lein on property
I am a member of a Home Association board. The question is, if you place a lein on property for failure to pay annual dues for one year and they do not pay the next year, do you have to file another lien on same property?

Yes - the notice of lien is only effective for the period asserted in it.

The bylaws withstanding, payment of assessments, together with interest, late charges, if any, costs of collection and reasonable attorney's fees may be enforced by the imposition of a lien on a unit in accordance with the provisions of the Maryland Contract Lien Act. Other aspects of law may apply where the Lien Act in inapplicable. Should the Board desire representation I am available.
