removing deadbeat from deed

I need help with the following: My problem is that my husband bought a house with a roommate. My husband is the only person on the mortgage but they are both on the deed. To make a long story short the roommate stopped paying his half of the mortgage 8 months ago and refuses to be removed from the deed. As it stands now the roommate has moved out but feels he has the right to enter the house anytime he wants.Do we have any rights now that we are the onlypeople living there? What can we do to get him off the deed?

This is a difficult situation. There may be some remedies, though they will depend on the circumstances that led to the room-mate being on the deed without being on the mortgage, as well as other factors. Unfortunately, the answer is not likely to be simple. Possibilities (suit for recission of the deed, suit for contribution, suit to divide and sell, etc.).
