Legal Question in Real Estate Law in Maryland
I rent an apartment and pay my rent on time every month. I got a subpoena in the mail to show up to court due for failure to pay rent... Not me! I went thru my statements and checkbook and everything checked out. Then I realized that it was my address but not my name at the top. They had the wrong person but sent it to my address. I talked to my leasing office and they said they would take care of it. A few days later I came home to the same court summons taped to my door. I'm afraid this other woman isn't going to show up to court and the sheriff's office is going to come throw my stuff out (I'm not home very often). I have no idea who she is so I can't deliver it to her. Who should I call? Should I show up to court on her date/time and tell them?
1 Answer from Attorneys
You could contact the attorney representing the Landlord and explain the mistake. (their information should be on the court papers).
Unless you can secure written confirmation that the Landlord's attorney has corrected this with the court, then yes, appearing in court may be prudent lest an eviction order is granted for the wrong apartment (yours).
Please note that this response is not intended as legal advice. You may want to consult with an attorney or perhaps reach out to the landlord-tenant hotline at the non-profit BNI (Baltimore Neighborhoods Inc) for further assistance.
