Rental property not as advertised

We just moved in to an apartment. They adverstise that they are newly remodeled. They specifcally mentioned new cinnimon toast carpeting. The model apartment was beautiful. When we moved in our apartment, it was quite different. The carpeting is old, worn, and stained. Besides that when you step onto a certain area in the living room the floor makes a loud popping noise. I believe the wood flooring underneath is not properly fastened. We are paying a good amount for this apartment.

First call the management company and tell them that you'd like to schedule the installation of the promised new cinnamon toast carpeting. I'm assuming that this promise was not reflected in the lease but is in literature or there was a verbal promise. Keep any ads and record when the promise was made and who made the promise. Consider visiting the model again and (if possible) discreetly take a picture of the carpet. If the new carpet is not in the lease, consider filing a complaint with the Better Business Bureau. If the carpet is included in the lease, consider sending them a letter threatening to file in small claims court if installation does not occur within a reasonable period of time (I'd say 60 days, but that's just a guess).
